TERMS OF SERVICE.
1. Agreement
These Terms of Service govern your use of the Atomic Engine platform operated by Atomic Engine Ltd ("we", "us", "our"), part of Straun Group, registered in Scotland, UK. By subscribing to or using Atomic Engine you agree to these Terms in full.
2. Services
Atomic Engine provides a managed AI agent platform on dedicated server infrastructure. Features available depend on your subscription tier (Atom, Proton or Fusion).
3. Subscription and Payment
- Subscriptions are billed monthly in advance in GBP.
- Payment is processed by Stripe. You authorise us to charge your payment method on the billing date each month.
- Failed payments result in a 7-day grace period. Service may be suspended after this if payment remains outstanding.
- All subscription fees are non-refundable except where required by law.
- We reserve the right to change pricing with 30 days' written notice.
4. Acceptable Use
You agree not to use Atomic Engine to violate any law, transmit spam, gain unauthorised access to any system, harm third parties, or reverse engineer our proprietary systems.
5. AI Usage and Spend Caps
Each tier includes a daily AI spend cap (Atom: £5/day, Proton: £10/day, Fusion: £20/day). When a cap is reached, agent activity is automatically throttled. AI API costs are absorbed within these caps as part of your subscription.
6. Data and Privacy
Your use of Atomic Engine is also governed by our Privacy Policy. You retain ownership of all data you input into the platform.
7. Uptime and Support
We target 99.9% uptime for all client servers. Health checks run every 5 minutes with a 4-hour recovery target for incidents.
8. Intellectual Property
All platform software, skills and proprietary systems remain the intellectual property of Atomic Engine Ltd. You are granted a non-exclusive, non-transferable licence to use the platform for the duration of your subscription.
9. Limitation of Liability
Our total liability for any claim shall not exceed the total fees paid by you in the 3 months preceding the claim. We are not liable for indirect, incidental or consequential damages.
10. Termination
You may cancel at any time via your billing dashboard. Cancellation takes effect at the end of the current billing period. We may terminate your account immediately for material breach of these Terms.
11. Governing Law
These Terms are governed by the laws of Scotland, UK. Disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
12. Changes to Terms
We may update these Terms with at least 30 days' notice. Continued use after the effective date constitutes acceptance.
